1. Acceptance of Terms
These Terms & Conditions govern access to and use of gowanty.com and any related services, ordering flows, customer support interactions, and digital product delivery features made available by GOWANTY LLC (collectively, the "Service"). By accessing the Service, creating an account, placing an order, or otherwise using the website, you agree to be bound by these Terms & Conditions and by our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract in order to use the Service or place an order. By placing an order, you represent that the information you provide is accurate, complete, and not misleading.

3. Business Model and Seller Status
GOWANTY operates as an independent reseller of digital goods, including digital gift cards, prepaid products, vouchers, subscriptions, gaming products, mobile top-ups, activation codes, eSIM-related products, and other electronically delivered access products. Unless expressly stated otherwise, GOWANTY is not the manufacturer, publisher, issuer, brand owner, platform owner, or official distributor of the relevant product or service. Product availability, denominations, supported countries, eligibility requirements, redemption conditions, activation success, platform compatibility, balance-check functionality, and certain compliance requirements may depend on third-party suppliers, issuers, aggregators, payment networks, and external platforms, including, where applicable, providers such as Reloadly, Zendit / IDT, Tillo, and other fulfillment or distribution partners.

4. Product Information, Descriptions, and Availability
We aim to keep product pages accurate and current. However, descriptions, images, supported regions, countries served, redemption methods, issuer or brand terms, denomination rules, expiration conditions, and other product information may be supplied or structured by third-party providers or issuers. Images and descriptions are therefore informational in nature, and the actual activation flow, redemption flow, or interface on a third-party platform may differ from what appears on our website. If a product page, checkout screen, confirmation email, or product instructions display items such as Countries Served, Redemption Method, denomination rules, issuer terms, brand-specific terms, platform conditions, language limitations, or eligibility rules, those disclosures form part of the product description and the conditions of your purchase. We reserve the right to correct errors, update information, limit quantities, refuse orders, or cancel transactions in the event of pricing errors, supplier issues, fraud concerns, technical issues, or legal or regional restrictions.

5. Compatibility, Regional Restrictions, and Customer Responsibility
Before purchase, you are responsible for verifying that a product is compatible with your account, platform, device, operating system, geographic region, and intended use. If a product page includes labels such as Global, US Only, EU, country-specific restrictions, redemption method disclosures, platform restrictions, issuer rules, or brand-specific conditions, those disclosures are part of the product conditions. Failure to review or correctly understand regional restrictions, redemption method requirements, platform limitations, language restrictions, eligibility rules, issuer terms, or brand conditions is not a basis for a refund, replacement, or payment dispute unless otherwise required by applicable law.

6. Pricing, Taxes, and Payment
Prices, currencies, promotions, payment processing methods, and product availability may change at any time before payment is successfully authorized and the order is accepted. Applicable taxes may be added where required by law. Payments are processed through third-party payment processors and gateways. We do not store full payment card numbers or complete payment credentials. We may delay, suspend, reject, or cancel an order if fraud screening, sanctions review, identity verification, technical controls, payment review, or risk scoring indicates elevated risk.

7. Order Review and Fraud Prevention
To protect the Service, our customers, suppliers, and payment partners, we may use automated and manual review tools, including transaction metadata analysis, IP address review, device signals, login and session activity, velocity checks, account history, delivery logs, behavioral risk indicators, and other anti-fraud controls. Before fulfillment, we may request additional verification, temporarily hold delivery, restrict payment methods, apply manual review, or reject an order. Failure to satisfy a reasonable verification request, or submission of inaccurate or misleading information, may result in order cancellation, account restriction, or refusal of future purchases.

8. Digital Delivery and Start of Performance
All products are delivered electronically, including through on-screen display, customer account access, secure links, or email to the address provided at checkout. Delivery is deemed complete, and performance is deemed to have begun, once the code, link, license, prepaid value, eSIM information, or other digital access data has been made available to you or sent to the email address you provided. You are responsible for entering the correct email address and for maintaining access to your email account and device. We are not responsible for failed delivery caused by an incorrect email address, spam filtering, inbox limitations, email provider issues, or compromise of your email account.

9. Risk Transfer and Security
The risk of loss, unauthorized use, disclosure, transfer, or misuse of a digital code or access credential passes to you upon delivery as defined above. You are solely responsible for securing your email account, device, login credentials, and purchased codes. We are not liable for losses resulting from code sharing, email forwarding, account compromise, malware, phishing, or other security failures on the customer side.

10. Refund Policy for Digital Goods
Because our products are digital goods that are often delivered instantly and cannot be returned in their original unused state after disclosure, receipt, delivery, or activation, all sales are generally final. By placing an order for immediate digital delivery, you expressly request immediate performance and acknowledge that, where applicable law provides for such consequences, your statutory right to cancel or withdraw may be limited or lost once performance begins.

Refunds, replacements, or store credit may be considered only in limited circumstances: (a) the product was not delivered; (b) the delivered product materially differs from what was ordered; (c) the code or other digital access data is proven to have been non-functional on first use; or (d) a duplicate transaction occurred due to a technical processing error. Any such request is subject to our verification procedure and, where relevant, supplier or issuer review.

Refunds, replacements, or credit will not be provided if the product was redeemed, activated, used, consumed, transferred, resold, gifted, disclosed to a third party, or rendered incompatible because the customer failed to review the product page, region label, account eligibility rules, issuer terms, platform requirements, or redemption method.

If you claim that a code is defective or non-functional, you must contact us within fourteen (14) days of delivery and provide sufficient evidence for investigation. Evidence may include error screenshots, a complete activation video, account region details, date and time evidence, order details, and any other information reasonably requested by us or the supplier. We may reject a claim if evidence is insufficient, if prior redemption or use is indicated, or if the claim cannot be confirmed by the relevant supplier, issuer, or platform.

11. Third-Party Platforms, Embedded Infrastructure, and Activation Issues
Redemption, validation, activation, balance checks, and ongoing product support may occur on third-party systems outside our control. Portions of the Service may be technically enabled through embedded, white-label, API-based, or supplier-hosted infrastructure operated by third-party providers, aggregators, issuers, brands, payment networks, or platform partners. Certain products may also be subject to additional third-party rules relating to eligibility, geographic restrictions, KYC or compliance checks, expiration periods, denomination limits, cancellation options, balance verification, or other operational conditions. We do not guarantee uninterrupted availability of any third-party platform, continued support by an issuer or brand, or the future validity of a supplier ecosystem. We may assist with diagnosis, but activation or redemption outcomes may depend on supplier, issuer, or platform decisions.

12. Chargebacks, Payment Disputes, and Abuse
If you initiate a payment dispute or chargeback, we may submit evidence to the payment processor, card network, acquiring bank, anti-fraud provider, dispute platform, supplier, issuer, or fulfillment partner, including order records, delivery logs, IP address data, device data, usage indicators, communications, verification signals, and supplier review results. If we reasonably determine that a dispute is abusive, fraudulent, duplicative, or contrary to evidence of delivery, product rules, or usage, we may suspend or close your account, refuse future orders, block associated email addresses, accounts, devices, or payment methods, and share the minimum necessary information with payment processors, fraud prevention providers, suppliers, issuers, or other risk-management partners where permitted by law and reasonably necessary to prevent fraud, abuse, or chargeback losses.

13. Prohibited Use
- commit fraud, money laundering, sanctions evasion, or unauthorized payment use
- abuse promotions, refunds, cancellations, or chargebacks
- use bots, scraping tools, exploit technical vulnerabilities, or interfere with our systems
- circumvent regional, platform, issuer, or eligibility restrictions unlawfully
- resell products where prohibited by law or by product conditions
- infringe third-party rights or impersonate another person

14. Accounts and Communications
If you create an account, you are responsible for maintaining its confidentiality and for all activity carried out through it. We may send transactional emails and service notices relating to your account, orders, security, legal updates, or customer support. Marketing communications are governed by our Privacy Policy and your marketing preferences.

15. Intellectual Property
The Service, including our website design, text, graphics, layout, and original content, belongs to GOWANTY or is used under license and is protected by applicable intellectual property laws. Third-party product names, logos, trademarks, and brands remain the property of their respective owners and are used only for identification, compatibility, or descriptive purposes.

16. Disclaimer of Warranties
To the maximum extent permitted by law, the Service and all products are provided on an "as is" and "as available" basis. We disclaim all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, secure, or continuously available, or that any third-party platform will accept, recognize, or continue supporting a product after delivery.

17. Limitation of Liability
To the maximum extent permitted by law, GOWANTY, its officers, members, employees, contractors, suppliers, and affiliates will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, or for any loss of profits, revenue, goodwill, data, business opportunity, or anticipated savings arising out of or relating to the Service, any product, any third-party platform, or these Terms, even if advised of the possibility of such damages. GOWANTY’s aggregate liability for any claim relating to an order or product will not exceed the amount actually paid by you to GOWANTY for the relevant order or product.

18. Indemnification
You agree to defend, indemnify, and hold harmless GOWANTY, its officers, members, employees, contractors, affiliates, and suppliers from and against any claims, losses, liabilities, damages, judgments, fines, costs, and expenses, including reasonable attorneys’ fees, arising from your misuse of the Service, breach of these Terms, infringement of rights, fraud, abusive chargebacks, or other unlawful conduct.

19. Suspension and Termination
We may suspend, restrict, refuse, or terminate access to the Service, any account, or any order at any time, with or without notice, where we suspect fraud, abuse, legal risk, sanctions exposure, repeated disputes, policy violations, misuse of support processes, or excessive operational risk.

20. Governing Law and Dispute Resolution
These Terms and any dispute or claim arising out of or relating to the Service or any purchase are governed by the laws of the State of New York, United States, without regard to conflict of law principles. Before initiating formal proceedings, you and GOWANTY agree to attempt in good faith to resolve the dispute informally by contacting us at support@gowanty.com.

If a dispute cannot be resolved informally, either party may bring an individual claim in small claims court where permitted, or otherwise seek binding individual arbitration instead of court litigation, unless applicable law prohibits mandatory arbitration. You and GOWANTY waive the right to participate in a class action, class arbitration, or representative proceeding to the extent permitted by law.

21. Mandatory Consumer Rights
Nothing in these Terms excludes, limits, or narrows any consumer right, refund right, guarantee right, privacy right, or other protection that cannot lawfully be excluded under applicable law. If you are located in a jurisdiction that grants mandatory consumer protections, those protections apply only to the extent they cannot be lawfully waived.

22. Changes to These Terms
We may update these Terms from time to time. The updated version becomes effective when posted on the website unless a later date is stated. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance of the updated Terms.
